Full-Day
Fees are based on a flat fee per party for each mediation day.
A typical full-day mediation begins at 9:30 a.m., includes a working lunch, and continues until completion. While most sessions conclude by 6:00 p.m., a session may extend into the evening if progress is being made. If the mediation extends past nine hours, the mediator reserves the right to charge an overtime fee of $350 per hour.
Full-day mediation (2 parties) $1950/party. For more than 2 parties $1500/party.
Half-Day
Fees are based on a flat fee per party for each mediation half-day.
Half-day mediations begin at 9:30 a.m. or 1:30 p.m. and end at 1:30 p.m. or 6:00 p.m.
Half-day mediation (2) parties $950/party. For more than 2 parties $750/party.
Overview
Only about 10% of cases require more than one mediation session.
If needed, subsequent sessions are scheduled through consent of the parties.
The daily fee includes:
- Hosting and administering the session(s)
- Pre-mediation attorney conferences
- Conducting the mediation session(s)
- Lunch and refreshments for all parties
- Preparation of mediation settlement agreement, with input and assistance of counsel
- Post mediation conferences with counsel
All parties represented by the same attorney are considered one party for the purposes of the mediation fee. Otherwise, each party is charged a separate fee and provided a separate room. Depending on alignment of the parties and the potential for realizing settlement efficiencies, technically adverse but closely aligned parties may be treated as one party and charged the single party fee if requested by counsel. If disputes or potential disputes arise, Tom reserves the right to separate these parties.
Expenses
Tom is willing to mediate at locations more convenient for the parties, but travel and lodging costs incurred by the mediator must be separately reimbursed.
